DIGEST AND PURPOSE 

The first proposal to acquire and construct the Post Reservoir, which would
be located on the North Fork of the Double Mountain Fork of the Brazos
Rivers in Garza County, was submitted to the White River Municipal Water
District in 1968 for an estimated cost of $2.2 million. The Post Reservoir
site project has been proposed again for an estimated cost of $28,200,000
to provide surface water supply to a local area which may not be able to
finance the project. H.B. 3096 provides for the construction of the Post
Reservoir site and the financing of the project from the state
participation account under the state participation program of the Texas
Water Development Board.  

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

ARTICLE 1

SECTION 1.01. Sets forth provisions regarding the creation of the Post
Reservoir site. 

SECTION 1.02. Authorizes the Texas Water Development Board (board) to
perform certain procedures. Requires purchase of the board's interest in
the reservoir by certain entities to begin not later than 20 years after
the execution of the contract. Sets forth legislative findings. 

ARTICLE 2

SECTION 2.01. Amends Chapter 221(8) and (9), Acts of the 55th Legislature,
Regular Session, 1957, as follows: 

Sec. 8. Provides that the (district) is authorized to acquire, construct,
own, or operate within or without the boundaries of the district, a dam or
dams all works, plants and other facilities necessary or useful for the
purpose of impounding, processing and transporting water to cities and
others for certain purposes. Deletes text which limited the district only
to the county in which the district is located.  

Sec. 9. Deletes text providing that the district is not authorized to
develop or acquire underground sources of water. Makes a conforming change. 

SECTION 2.02. Amends Chapter 221(10)(a), Acts of the 55th Legislature,
Regular Session, 1957, to make a conforming change. 

ARTICLE 3

SECTION 3.01. Effective date: upon passage or September 1, 2001.
