BACKGROUND AND PURPOSE 

Currently, after an owner or a person authorized to act on behalf of an
owner receives a written request from a contractor for properly performed
work or suitably stored or specially fabricated materials, the owner is
required to pay the contractor within 35 days after the owner receives the
request. This can lead to delays in a contractor paying its subcontractors.
House Bill 3122 shortens from 35 to 21 days the time that an owner has to
pay a contractor for such services. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 3122 amends the Property Code to decrease from 35 to 21 days the
time period which an owner is required to pay a contractor after receiving
a request for payment for properly performed work or suitably stored or
specially fabricated materials. 

EFFECTIVE DATE

September 1, 2001.
