BACKGROUND AND PURPOSE 

Currently, Texas law imposes a 10 year statute of limitations on an action
for damages from injury or loss caused by an error in a survey.  However,
the statute of limitations for negligence is two years and for a debt is
four years, which indicates that the statute of limitations for an error in
a survey is too long.  House Bill 3136 shortens the statute of limitation
for damages caused by an error in a survey from 10 years to four years.   

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 3136 amends the Civil Practices and Remedies Code to modify the
statute of limitations for an injury or loss caused by an error in a survey
conducted by a registered public surveyor or a licensed state land surveyor
from 10 years to four years after the date the survey is completed.   

EFFECTIVE DATE

September 1, 2001.
