BACKGROUND AND PURPOSE 

Under current law, the district judges of Angelina County are required to
appoint bailiffs and set their salaries.  The bailiffs are funded through
the county's budget which is set by the county commissioners court.  The
bailiff's salary is not commensurate with the salaries of other officers.
House Bill 3356 allows for district and county court at law judges in
Angelina County to appoint a bailiff, and for the county commissioners
court to set the salary for bailiffs at not less than the salary of a
deputy sheriff assigned to regular duty. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 3356 amends the Government Code to require the judges of the
district courts having jurisdiction in Angelina County and the judges of
the county courts at law in Angelina County to each appoint a bailiff.  The
bill provides that each bailiff appointed by a judge of a district court
having jurisdiction in Angelina County or a county court at law judge in
Angelina County is entitled to receive a salary set by the commissioners
court of that county in an amount that is not less than the salary of a
deputy sheriff regularly assigned to patrol duty in the county. 

EFFECTIVE DATE

September 1, 2001.
