SRC-JEC H.B. 3465 77(R) BILL ANALYSIS Senate Research Center H.B. 3465 77R4708 JMM-DBy: Maxey (Shapleigh) Health & Human Services 5/8/2001 Engrossed DIGEST AND PURPOSE The Texas Board of Health sets fees, not to exceed a maximum amount established under current law, for obtaining and maintaining registration under the Opticians' Registry Act. With the growing number of voluntary registrants the specified fee amounts are not sufficient to absorb the cost of administering the Act. H.B. 3465 requires the board to prescribe by rule the fees in amounts sufficient to cover the costs of administering the Act and removes the maximum amounts. RULEMAKING AUTHORITY Rulemaking authority is expressly granted to the Texas Board of Health in SECTION 1 (Section 352.054, Occupations Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 352.054, Occupations Code, to require the Texas Board of Health by rule to prescribe fees in reasonable amounts to cover the costs of administering this chapter, including fees for certain purposes. Deletes text delineating maximum fees for certain purposes. SECTION 2. (a) Effective date: September 1, 2001. (b) Requires the Texas Board of Health to prescribe fees under Section 352.054, Occupations Code, as amended by this Act, not later than January 1, 2002. Provides that the amount of a fee under Chapter 352, Occupations Code, in effect before the effective date of this Act remains in effect until the Texas Board of Health adopts a new amount for that fee as required by this Act.
