HBA-KDB H.B. 3536 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3536 By: Dukes State Affairs 4/4/2001 Introduced BACKGROUND AND PURPOSE Under current law, a state agency is prohibited from accepting a bid or awarding a contract that includes proposed financial participation by a person who received compensation from the agency in preparing specifications or requests for proposals. However, a state agency may still accept such a bid from or award such a contract to a person who did not receive compensation from the state agency, but who did participate in any extent in preparing the specifications or request for proposals on which the bid or contract is based. House Bill 3536 prohibits a state agency from accepting such a bid from or awarding such a contract to a person who participated in any extent in preparing the specifications or request for proposals on which the bid or contract is based. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 3536 amends the Government Code to prohibit a state agency from accepting a bid or awarding a contract that includes proposed financial participation by a person who participated in any extent in, rather than a person who received compensation from the agency, preparing the specifications or request for proposals on which the bid or contract is based. The bill prohibits a state agency from accepting a bid from a person or business which has been determined ineligible by the General Services Commission. EFFECTIVE DATE September 1, 2001.
