BACKGROUND AND PURPOSE 

Under current law, the General Services Commission (GSC) is authorized to
bar certain vendors who perform substandard work quality, misrepresent
material or goods in the bidding process, commit fraud, or breach a
contract from doing business with the state.  House Bill 3537 expands the
stipulations for barring vendors and requires rather than authorizes GSC to
bar certain vendors.   

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 3537 amends the Government Code to require the General Services
Commission (GSC) to bar a vendor from participating in state contracts for: 

 _breaching a contract with  local or quasi-governmental entities in Texas
including but not limited to cities, counties, housing authorities,
transportation authorities, river authorities, or other similar public
purpose entities; or 
 
 _ misrepresentation to subcontractors as to the amount and scope of their
participation in previous awards made by state, local, or
quasi-governmental entities in Texas or other entities.  

The bill requires rather than authorizes GSC to bar a vendor from
participation in state contracts for certain behavior.  The bill also
establishes that state institutions of higher learning are not exempt from
the State Purchasing and General Services Act. 

EFFECTIVE DATE

September 1, 2001.
