BACKGROUND AND PURPOSE 

Under current law, certain retired teachers are allowed to continue to
collect retirement benefits if they return to teaching in areas of acute
teacher shortage.  The provision allows understaffed schools to hire
experienced teachers and benefit from their experience. Current law also
prescribes a minimum monthly salary that a teacher must receive.
Understaffed schools are often understaffed precisely because they do not
have the resources to pay this minimum salary.  House Bill 3569 exempts
certain retired teachers from minimum monthly salary requirements. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 3569 amends the Education Code to exempt from minimum monthly
salary requirements  the salary of a classroom teacher who is a retiree of
the Teacher Retirement System of Texas and qualifies to receive benefits
while employed as a classroom teacher. 

EFFECTIVE DATE

On passage, or if the Act does not receive the necessary vote, the Act
takes effect September 1, 2001.
