SRC-MWN H.B. 3629 77(R) BILL ANALYSIS Senate Research Center H.B. 3629 77R8163 QS-FBy: Green (Armbrister) Natural Resources 5/9/2001 Engrossed DIGEST AND PURPOSE The Texas Constitution authorizes the creation of water control and improvement districts to supply and store water for use, operate sanitary wastewater systems, and provide irrigation, drainage, and water quality services. On January 16, 2001, the Hays County Commissioners Court adopted a petition for the creation of Hays County Water Control and Improvement District No. 2 (district) to cope with the continual growth of the Hays County area. H.B. 3629 validates the creation of the district, subject to voter approval at a confirmation election. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. VALIDATION OF CREATION. Validates the of creation of the Hays County Water Control and Improvement District No. 2 (district). SECTION 2. DEFINITION. Defines "district." SECTION 3. BOUNDARIES. Provides that the district's boundaries are those as found by the Hays County Commissioners Court's order creating the district on January 16, 2001. SECTION 4. FINDINGS RELATIVE TO BOUNDARIES. Sets forth findings relative to the boundaries of the district. SECTION 5. FINDING OF BENEFIT. Sets forth provisions regarding the finding of benefit of the district. SECTION 6. POWERS. Sets forth provisions regarding the powers of the district. SECTION 7. EFFECTIVE DATE; EXPIRATION DATE. (a) Effective date: upon passage or September 1, 2001. (b) Provides that if the creation of the district is not confirmed at a confirmation election before September 1, 2003, this Act expires on that date.
