SRC-MWN H.B. 3635 77(R) BILL ANALYSIS Senate Research Center H.B. 3635 By: Cook (Armbrister) Natural Resources 4/29/2001 Engrossed DIGEST AND PURPOSE Currently, the Wharton County Commissioners Court perform the duties for promoting improved drainage and flood control in Wharton County. An ongoing program of improved drainage and flood control is important as the population of the county grows. H.B. 3635 establishes the Wharton County Drainage District, giving the commissioners court the powers and duties of a drainage district. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. CREATION. Sets forth provisions regarding the creation of the Wharton County Drainage District. SECTION 2. DEFINITION. Defines "district." SECTION 3. BOUNDARIES. Sets forth proposed boundaries of the district. SECTION 4. FINDING OF BENEFIT. Sets forth provisions regarding the benefit of the district. SECTION 5. GENERAL POWERS. Sets forth provisions regarding the powers of the district. SECTION 6. BOARD OF DIRECTORS. Provides that the district is composed of certain persons. SECTION 7. CONFIRMATION ELECTION. Sets forth provisions regarding the calling and holding of an election. SECTION 8. FINDINGS RELATED TO PROCEDURAL REQUIREMENTS. Sets forth provisions regarding notice of the intention of the district has been fulfilled. SECTION 9. EFFECTIVE DATE; EXPIRATION DATE. (a) Provides that this Act takes effect September 1, 2001. (b) Provides that if the district is not confirmed by an election, this Act expires September 1, 2003.
