BACKGROUND AND PURPOSE 

The Upper Kirby Management District (district) in Houston was created by
the 75th Legislature to promote economic growth, cultural development, and
public welfare of the area.  The City of Houston has also created a tax
increment reinvestment zone (zone) in the area to attract new investment
and help finance the cost of redeveloping.  Prior to the 77th Legislature,
several property owners that are outside the district but inside the zone
petitioned to be included in the district.  Expanding the district would
allow the district and the zone to better coordinate the provision of
service and bring the petitioners into the district.  House Bill 3639
expands the boundaries of the district and authorizes the board of
directors of the district to increase the number of directors. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 3639 amends law to expand the boundaries of the Upper Kirby
Management District (district). The bill authorizes the board to increase
or decrease the number of directors to not more than nine and not fewer
than five directors on a finding by a majority of the board that the change
in the number of directors is in the best interest of the district. The
bill requires the existing board to appoint qualified persons to fill any
new positions on the board created by an increase in the number of
directors.  The bill names the persons to fill positions one through five
on the board, including expiration of terms.

September 1, 2001.
