DIGEST AND PURPOSE 

The Upper Kirby Management District (district) in Houston was created by
the 75th Legislature to promote economic growth, cultural development, and
public welfare of the area. The City of Houston has also created a tax
increment reinvestment zone (zone) in the area to attract new investment
and help finance the cost of redeveloping. Several property owners that are
outside the district but inside the zone have petitioned to be included in
the district. Expanding the district will allow the district and the zone
to better coordinate the provision of service and bring the petitioners
into the district. H.B. 3639 expands the boundaries of the district and
authorizes the board of directors of the district to increase the number of
directors.  

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 376.154(a), Local Government Code, to set forth
the boundaries of the Upper Kirby Management District.  Deletes existing
text regarding boundaries.   

SECTION 2.  Amends Section 376.158(a), Local Government Code, to provide
that, except as provided by this subsection, the district is governed by a
board of five directors who serve staggered four-year terms.  Authorizes
the board by resolution to increase or decrease the number of directors to
not more than nine and not fewer than five directors on a finding by a
majority of the board that the change in the number of directors is in the
best interest of the district. 

SECTION 3.  Amends Section 376.159, Local Government Code, to require the
existing board to appoint qualified person to fill any new positions on the
board created by an increase in the number of directors under Section
376.158(a) and provide for staggering the terms of directors serving in the
new positions.  Requires, on the expiration of the term of a director
appointed under this subsection, a succeeding director to be appointed and
qualify as provided by this section.   Makes a nonsubstantive change. 

SECTION 4. Sets forth guidelines regarding the composition and terms of the
board of the Upper Kirby Management District.  Provides that this section
expires September 1, 2005. 

SECTION 5.  Effective date:  September 1, 2001.
