SRC-MKV H.B. 3648 77(R) BILL ANALYSIS Senate Research Center H.B. 3648 77R7461 SGA-FBy: Hope (Bernsen) Natural Resources 5/9/2001 Engrossed DIGEST AND PURPOSE According to the 2000 federal census, Montgomery County's population increased 61.2 percent in the last decade. In eastern Montgomery County, where most of the growth has occurred, an economic development plan has been established to help improve the quality of life for residents residing in that portion of the county. A major component of the development plan is the creation of a municipal utility district (MUD) to improve the quality of water delivery in the county and help the county address critical water needs resulting from rapid population growth. H.B. 3648 creates the East Montgomery Municipal Utility District No. 3 in Montgomery County. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. CREATION. Sets forth provisions relating to the creation of the East Montgomery County Municipal Utility District No. 3 (district). SECTION 2. DEFINITION. Defines "district." SECTION 3. BOUNDARIES. Sets forth the boundaries of the district. SECTION 4. FINDINGS RELATING TO BOUNDARIES. Sets forth findings related to the boundaries of the district. SECTION 5. FINDING OF BENEFIT. Sets forth provisions relating to a finding of benefit. SECTION 6. POWERS. Sets forth provisions relating to the rights, powers, privileges, authority, functions, and duties of the district. SECTION 7. BOARD OF DIRECTORS. Sets forth provisions relating to the composition and terms of the board of directors. SECTION 8. APPOINTMENT OF TEMPORARY DIRECTORS. Sets forth provisions relating to appointment of temporary directors of the board. SECTION 9. CONFIRMATION AND INITIAL DIRECTORS' ELECTION. Sets forth provisions relating to an election to confirm establishment of the district and to elect five initial directors. SECTION 10. ELECTION OF DIRECTORS. Sets forth provisions relating to the election of permanent directors. SECTION 11. COMPLIANCE WITH MUNICIPAL ORDINANCE OR RESOLUTION. (b) Provides that if the creation of the district is not confirmed at a confirmation election held under SECTION 9 of this Act before September 1, 2004, this Act expires on that date.
