The Texas Constitution authorizes the creation of groundwater conservation districts to plan, develop, and regulate the use of water. H.B.3665 creates the Cross Timbers Groundwater Conservation District, subject to voter approval at a confirmation election, in Callahan, Erath, Somervell, Bosque, Comanche, Eastland, and Coryell counties. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. CREATION. Sets forth provisions regarding the creation of the Cross Timbers Groundwater Conservation District (district). SECTION 2. DEFINITION. Defines "district." SECTION 3. BOUNDARIES. Provides that the boundaries of the district are coextensive with the boundaries of certain counties. SECTION 4. FINDINGS OF BENEFIT. Sets forth provisions regarding the finding of benefit for the district. SECTION 5. GENERAL POWERS. Sets forth provisions regarding general powers of the district. SECTION 6. BOARD OF DIRECTORS. Sets forth provisions regarding the board of directors of the district. SECTION 7. COMPENSATION OF DIRECTORS. Provides that a director may not receive compensation but is entitled to reimbursement of actual expenses. SECTION 8. TEMPORARY DIRECTORS. Sets forth provisions regarding the temporary directors of the district. SECTION 9. METHOD OF ELECTING DIRECTORS. Sets forth provisions regarding the method of electing directors. SECTION 10. CONFIRMATION AND INITIAL DIRECTORS' ELECTION. Sets forth provisions regarding confirmation and initial directors election of the district. SECTION 11. ELECTION OF PERMANENT DIRECTORS. Sets forth provisions regarding the election of permanent directors. SECTION 12. DISTRICT REVENUES. Sets forth provisions regarding the utilization of district revenues. SECTION 13. (b) Provides that if the district is not confirmed at a confirmation election before September 1, 2003, this Act expires on that date.
