SRC-TBR H.B. 3666 77(R) BILL ANALYSIS Senate Research Center H.B. 3666 77R7385 KLA-DBy: Miller (Sibley) Intergovernmental Relations 5/7/2001 Engrossed DIGEST AND PURPOSE Under current law, a county court at law in Erath County does not have concurrent jurisdiction with the district court to hear cases involving matters in which a governmental entity files suit to protect the health and safety of a child. H.B. 3666 provides that the county court at law in Erath County has concurrent jurisdiction with the district court in proceedings relating to the custody, care, or control of a child by the Department of Protective and Regulatory Services. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 25.0742, Government Code, as follows: Sec. 25.0742. ERATH COUNTY COURT AT LAW PROVISIONS. (a) Provides that, in addition to the jurisdiction provided by Section 25.0003 and other law, a county court at law in Erath County has concurrent jurisdiction with the district court in proceedings under Chapter 262, Family Code, in which the Department of Protective and Regulatory Services has assumed the care, custody, and control of a child. (b) Subsection created from existing text. SECTION 2. Effective date: upon passage or September 1, 2001.
