HBA-EDN H.B. 3670 77(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 3670 By: Jones, Delwin Natural Resources 8/8/2001 Enrolled BACKGROUND AND PURPOSE Currently, the five directors of the Lubbock County Water Control and Improvement District No. 1 are elected at large from within the county for four-year staggered terms. In the interest of representative government, the citizens of Lubbock County should have a director who directly represents them. House Bill 3670 requires one director to be elected from each commissioners precinct in Lubbock County and one director to be elected from the county at large. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 3670 amends law to modify provisions relating to the election and qualifications of directors of the Lubbock County Water Control and Improvement District No. 1 (district). The bill requires one director to be elected from each commissioners precinct (precinct) in Lubbock County and one director to be elected from the district at large. The bill provides that a director from a precinct must be a resident of that precinct and that a director at large must be a resident of Lubbock County. The bill requires an election to be held on the first Saturday in May 2002 to elect five directors and requires the persons serving as directors of the district on September 1, 2001, to continue to serve as directors until such an election. Following this initial election, the bill requires an election to be held on the first Saturday in May of each even numbered-year to elect directors to the appropriate positions on the board. The bill requires that directors elected from precincts 1 and 3 serve two-year terms and that directors elected from precincts 2 and 4 and from the district at large serve four-year terms and specifies that directors are elected for fouryear staggered terms, except as provided.
