HBA-CMT H.B. 3683 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3683 By: Green County Affairs 4/25/2001 Introduced BACKGROUND AND PURPOSE The Hays County Commissioners Court created the Hays County Development District No. 1 in January 2000. The district's project includes 561 acres of land within the extraterritorial jurisdiction of the City of Dripping Springs. The proposed development includes a hotel, conference center, 18-hole golf course with attendant rental units and single family residential homes. House Bill 3683 approves the creation of the Hays County Development District No. 1 and clarifies provisions related to the administration, powers, and duties of the district. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 3683 approves the creation of the Hays County Development District No. 1 (district) (SECTION 2). The bill sets forth that the district's boundaries are those as found by the Hays County Commissioners Court's Order Hearing Granting Petition Requesting the Creation of the Hays County Development District No. 1 and Appointing Temporary Directors dated January 11, 2000 (SECTION 3). The bill sets forth the powers and duties of the district, including the authority to levy, assess, and collect ad valorem taxes and taxes for maintenance and operating purposes, and special assessments as well as authority to enter into obligations (SECTION 5). The bill sets forth administrative and election provisions for the board of directors of the district. The bill sets forth provisions pertaining to the terms of directors and provisions for the filling of a vacancy on the board of directors (SECTION 7). The bill sets forth procedures for the addition and exclusion of lands in the district (SECTION 9). The bill sets forth procedures for the dissolution of the district (SECTION 10). EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect August 28, 2001.
