HBA-JLV C.S.H.B. 3684 77(R)BILL ANALYSIS Office of House Bill AnalysisC.S.H.B. 3684 By: Green Natural Resources 5/4/2001 Committee Report (Substituted) BACKGROUND AND PURPOSE The Hays County Development District No. 1 was created to develop a residential area within the extraterritorial jurisdiction of the City of Dripping Springs. The area within the district is somewhat rural but is located in the growing environs of Central Texas' most populous and developing regions. Within the immediate future, the area will experience a substantial and sustained residential and commercial growth. However, there is currently inadequate water works, drainage and sewer treatment systems to properly service the area. There exists a public necessity for the district to provide, purchase, construct, improve, and extend such systems to promote the health and welfare of the community. C.S.H.B. 3684 creates the Hays County Water Control and Improvement District No. 4, subject to approval at a confirmation election, to manage Hays County's groundwater resources. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS C.S.H.B. 3684 creates the Hays County Water Control and Improvement District No. 4 (district), subject to voter approval at a confirmation election. The bill sets forth the boundaries and powers of the district (SECTIONS 3 and 6). The bill provides that the district is governed by a board of five directors and sets forth provisions regarding the composition, qualifications, and administration of the board and the election of the directors (SECTIONS 7-11). EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001. COMPARISON OF ORIGINAL TO SUBSTITUTE C.S.H.B. 3684 modifies the original to conform to Texas Legislative Council style and format and to remove provisions authorizing the district to conduct elections and levy, assess, and collect ad valorem taxes. The substitute removes the emergency clause from the original and modifies the effective date. The substitute provides for the qualifications of the board and sets forth the names of the temporary directors.
