HBA-CBW H.J.R. 61 77(R) BILL ANALYSIS Office of House Bill AnalysisH.J.R. 61 By: Gallego Judicial Affairs 2/21/2001 Introduced BACKGROUND AND PURPOSE Currently, the Texas Constitution requires the Judicial Districts Board (JDB) to make a statewide reapportionment of judicial districts following the decennial census if the legislature fails to do so by a certain deadline. If the JDB is unsuccessful, the reapportionment responsibility falls to the Legislative Redistricting Board. As proposed, House Joint Resolution 61 requires the submission to the voters for a constitutional amendment repealing the constitutional requirement for decennial reapportionment of the state's judicial districts and abolishing the Judicial Districts Board. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this resolution does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Joint Resolution 61 repeals the constitutional requirement for decennial reapportionment of the state's judicial districts and abolishes the Judicial Districts Board. FOR ELECTION This proposed constitutional amendment shall be submitted to the voters at an election to be held November 6, 2001.
