HBA-TBM S.B. 26 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 26 By: Shapiro Public Education 4/26/2001 Engrossed BACKGROUND AND PURPOSE Under current law, the commissioner of education (commissioner) may close a consistently low-performing school, but Texas does not have a program in place to reconstitute the school. No process allows the commissioner to take measures to disband a low-performing school's faculty and reopen the school with new staff. Senate Bill 26 authorizes the commissioner to reconstitute a school if the school is classified as low-performing for two or more consecutive years. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 26 amends the Education Code to provide that if a campus has been a low-performing campus for a period of two years or more, the commissioner of education is authorized to order reassignment to other appropriate positions in the district of some or all of the educators employed for at least the two preceding years on the campus. EFFECTIVE DATE Upon passage. The Act applies beginning with the 2001-2002 school year.
