SRC-CTC S.B. 30 77(R) BILL ANALYSIS Senate Research Center S.B. 30 77R71 BDH-DBy: Zaffirini Education 2/19/2001 As Filed DIGEST AND PURPOSE Currently, Texas does not mandate that children attend kindergarten before entering first grade. As proposed, S.B. 30 requires a child who is at least five years of age on September 1 to attend school. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 25.085 (b) and (c), Education Code, to require that a child attend school, unless exempted by Section 25.086, if that child is at least five, rather than six, years of age on the first day of September of the school year, or is younger than five, rather than six, and has been previously enrolled in kindergarten, rather than the first grade, and has not yet reached the child's 18th birthday. SECTION 2. Amends Section 29.009, Education Code, to make a conforming change. SECTION 3. Effective date: upon passage. Makes application of this Act prospective to the 2001-2002 school year.
