SRC-MKV S.B. 62 77(R) BILL ANALYSIS Senate Research Center S.B. 62 2001S0008/1By: Moncrief Health and Human Services 1/24/2001 As Filed DIGEST AND PURPOSE Currently, a county of at least 2.8 million may require the payment of a fee for issuing or renewing a permit for performing an inspection of a food establishment. This bill allows counties of at least one million to do so and allows those counties more control over food establishments and inspection of food and over the duration and intensity of inspection. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 437.0123(a), Health and Safety Code, to authorize a county with a population of at least one million, rather than 2.8 million, or a public health district at least part of which is in a county of at least 2.8 million to require the payment of a fee for issuing or renewing a permit or for performing an inspection to enforce this chapter or a rule adopted under this chapter. SECTION 2. Effective date: September 1, 2001.
