DIGEST AND PURPOSE 

C.S.S.B. 62 allows counties to increase fees for issuing or renewing
permits for food service establishments, providing more flexibility in
charging for permits.  This bill also allows for greater flexibility based
on the duration and intensity of inspection, making inspections more
efficient. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 437.012 (b) , Health and Safety Code, to
prohibit the fee charged by a county or public health district for issuing
or renewing a permit from exceeding $300.  Deletes previous language
prohibiting the fee from exceeding $150 or the highest fee charged by a
municipality in the county or public health district, whichever amount is
less. 

SECTION 2.  Effective date: September 1, 2001.

SUMMARY OF COMMITTEE CHANGES

Differs from original by amending Section 437.012 (b), Health and Safety
Code, whereas the original amended Section 437.0123 (a), Health and Safety
Code, authorizing a county with a certain population to require fee payment
in connection with permits or inspections.
