SRC-MWN S.B. 73 77(R) BILL ANALYSIS Senate Research Center S.B. 73 77R63 JSA-DBy: Haywood Education 1/26/2001 As Filed DIGEST AND PURPOSE Currently, Midwestern State University does not have the grounds for removal of a board member included in its operating statute. As proposed, S.B. 73 provides guidelines that put in place grounds for removal of a board member. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 103, Education Code, by adding Section 103.031, as follows: Sec. 103.031. GROUNDS FOR REMOVAL OF BOARD MEMBER. Provides that it is a ground for removal from the board that a member commits malfeasance of office; cannot, because of illness or disability, discharge the member's duties for a substantial part of the member's term; or is absent from more than half of the regularly scheduled board meetings that the member is eligible to attend during a calender year, unless the absence is excused by majority vote of the board. Provides that the validity of an action of the board is not affected by the fact that it was taken when a ground for removal of a board member existed. SECTION 2. Effective date: upon passage.
