SRC-MKV S.B. 76 77(R)BILL ANALYSIS Senate Research CenterS.B. 76 By: Haywood Education 5/22/2001 Enrolled DIGEST AND PURPOSE It is the practice of the Texas Legislative Council to format all codes and statutes to use gender neutral language. The Midwestern State University operating code uses the word "chairman" instead of "chairperson" when referring to the board of directors. The operating code also contains no provision regarding the authority to convene a meeting of the board of directors. It is common practice for the chair to call the meetings when needed, but the legal authority to do so has not previously been granted. This bill changes the term "chairman" to "chairperson" and gives the chairperson legal authority to call meetings of the board of directors. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 103.05, Education Code, as follows: Section 103.05. New heading: BOARD OFFICERS; MEETINGS. Authorizes the chairperson to convene a meeting of the board of regents when the chairperson considers it appropriate to consider any business related to the university. Makes nonsubstantive changes. SECTION 2. Effective date: upon passage.
