DIGEST AND PURPOSE 

Currently, some school districts have ownership of historic one-room
schoolhouses.  As proposed, C.S.S.B. 116 allows the board of trustees of
school districts to donate this property to certain entities in the
interest of preservation. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Chapter 11D, Education Code, by adding Section 11.1541,
as follows: 

Sec. 11.1541. DONATION OF SURPLUS PROPERTY. Authorizes the board of
trustees of an independent school district to donate excess real property
and improvements previously used as a school campus to a municipality,
county, or nonprofit organization.  Sets forth conditions the board must
follow before the transfer can take place.  Requires the president of the
board of trustees to execute a deed containing certain information
transferring the property and improvements.  Defines "nonprofit
organization." 

SECTION 2. Effective date: January 1, 2002.
Makes application of this Act contingent upon the passage of the
constitutional amendment proposed by the 77th Legislature, Regular Session,
2001, authorizing donation of surplus school district property of
historical significance. 

SUMMARY OF COMMITTEE CHANGES

Differs from the original by adding certain conditions under which the
board may authorize the donation of certain real property and improvements
to a municipality, county, or nonprofit organization.  Adds certain
functions the deed must serve in transferring ownership of the real
property and improvements to the municipality, county, or nonprofit
organization.
