DIGEST AND PURPOSE 

S.B. 137 calls for transferring jurisdiction over the San Jacinto
Battleground and Battleship Texas from the Parks and Wildlife Department to
the Texas Historical Commission. 

RULEMAKING AUTHORITY

Rulemaking authority is expressly granted to the Texas Historical
Commission in SECTION 3 of this bill. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Sections 22.011 - 22.016 (relating to the San Jacinto
Historical Advisory Board) and Section 22.261 (Jurisdiction), Parks and
Wildlife Code, to redesignate them as Sections 442.017 442.023, Government
Code.  

Section 442.017.  New heading: SAN JACINTO BATTLEGROUND.  Changes reference
of department to commission. 

Section 442.018.  SAN JACINTO HISTORICAL ADVISORY BOARD.  Changes reference
from Battleship Texas Commission to Texas Historical Commission.  Makes a
conforming change. 

Section 442.019.  New heading: MEETINGS OF SAN JACINTO HISTORICAL ADVISORY
BOARD.  Deletes language relating to delivery of minutes or bylaws to the
commission by the member of the board who is an employee of the department.
Makes  conforming changes. 

Section 442.020.  New heading: POWERS OF SAN JACINTO HISTORICAL ADVISORY
BOARD.  Makes a conforming change. 
 
Section 442.021.  New heading: DATA COLLECTED BY SAN JACINTO HISTORICAL
ADVISORY BOARD.  Makes a conforming change. 

 Section 442.023.  New heading: BATTLESHIP "TEXAS".  Makes a conforming
change. 

 
SECTION 2.  Repealer: headings to Chapter 22B (San Jacinto Battleground)
and Chapter 22T (Battleship "Texas"), Parks and Wildlife Code. 

SECTION 3.  (a) Sets forth that on September 1, 2001 the following are
transferred to the Texas Historical Commission: 

(1) all powers, duties, obligations, and liabilities of the Parks and
Wildlife Department (department)  relating to the San Jacinto Battleground
(battleground) and the Battleship "Texas" (battleship); 

(2) all unobligated and unexpended funds appropriated to the department
designated for  the administration of the battleground or battleship; 

(3) all equipment and property of the department used for the
administration of or related to the battleground or battleship; and 

(4) all files and other records of the department kept regarding the
battleground or battleship. 

(b) Provides that a rule adopted by the department that is in effect
immediately before September 1, 2001, and that relates to the battleground
or battleship is, on September 1, 2001, a rule of the Texas Historical
Commission and remains in effect until amended or repealed by the Texas
Historical Commission. 

SECTION 4.  Effective date: September 1, 2001.
