SRC-SEW, MKV S.B. 154 77(R)BILL ANALYSIS Senate Research CenterS.B. 154 By: Truan State Affairs 5/28/2001 Enrolled DIGEST AND PURPOSE Currently, the need for organ and tissue transplants far exceeds the number of donated organs and tissue. S.B. 154, in order to increase awareness of this need and remind students in driver's education and safety courses of one of the most devastating consequences of unsafe driving, requires that information about anatomical gifts be included in the curriculum of certain driver education and driving safety courses. RULEMAKING AUTHORITY Rulemaking authority is expressly granted to the commissioner of education in SECTIONS 1 and 2 (Section 6(d), Article 4413 (29c), V.T.C.S.) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 4413 (29c), V.T.C.S., by adding Section 6(d), to require the commissioner of education by rule to require information relating to anatomical gifts to be included in the curriculum of each driver education and driving safety course. Requires curriculum to include information about the matters listed in Section 46.001(a) (Development and Implementation of Program), Health and Safety Code, as added by Chapter 1516, Acts of the 76th Legislature, Regular Session, 1999. Requires the commissioner to consult with the Department of Public Safety and the Texas Department of Health in developing rules under this subsection. SECTION 2. Requires the commissioner of education to adopt rules under Section 6(d), Article 4413 (29c), V.T.C.S., as added by this Act, not later than January 1, 2002. SECTION 3. Effective date: upon passage or September 1, 2001.
