SRC-JEC S.B. 202 77(R) BILL ANALYSIS Senate Research Center S.B. 202 77R2493 ATP-DBy: Duncan Intergovernmental Relations 1/17/2001 As Filed DIGEST AND PURPOSE Under current law, governmental units may contract to furnish or obtain fire protection services, and the requesting entity is responsible for any civil liability arising from the furnishing of those services. As proposed, S.B. 202 includes police protection services in the same arrangement. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 791.006, Government Code, as follows: Sec. 791.006. New heading: LIABILITY IN FIRE OR POLICE PROTECTION CONTRACT. Provides that if governmental units contract under this chapter to furnish or obtain police protection services, the governmental unit that would have been responsible for furnishing the services in the absence of the contract is responsible for any civil liability that arises from the furnishing of those services. SECTION 2. Effective date: September 1, 2001.
