HBA-MSH S.B. 209 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 209 By: Bivins Public Education 3/18/2001 Engrossed BACKGROUND AND PURPOSE The State Board of Education (SBOE) may establish a special-purpose school district for the education of students in special situations whose educational needs are not adequately met by regular school districts. SBOE appoints a three member board of trustees for each special-purpose school district. With only three trustees, the workload can be large for each individual trustee, and there is a minimum of input in the the board's decisions. Senate Bill 209 authorizes SBOE to appoint boards of five or seven trustees for specialpurpose school districts. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 209 amends the Education Code to authorize the State Board of Education to appoint to each special-purpose school district a board of five or seven trustees. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001.
