SRC-JEC S.B. 231 77(R) BILL ANALYSIS Senate Research Center S.B. 231 77R1484 AJA-DBy: Harris Intergovernmental Relations 1/18/2001 As Filed DIGEST AND PURPOSE Under current law, the Department of Public Safety is exempt from liability for the wrongful act, omission, or the negligence of an off-duty officer. S.B. 231 similarly exempts a municipality or county from liability for the wrongful act, omission, or the negligence of an off-duty law enforcement officer. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 101.065, Civil Practice and Remedies Code, to make this chapter inapplicable to the wrongful act or omission or the negligence of a law enforcement officer employed by a county or municipality if the officer was not on active duty at the time the act, omission, or negligence occurred. SECTION 2. Effective date: September 1, 2001. Makes application of this Act prospective.
