SRC-JBJ S.B. 268 77(R) BILL ANALYSIS Senate Research Center S.B. 268 77R2453 DWS-DBy: Ogden Criminal Justice 2/27/2001 As Filed DIGEST AND PURPOSE Under current Texas law, the fine for a misdemeanor traffic offense is not less than $1 or more than $200. As proposed, S.B. 268 provides for an increased fine for persons penalized for exceeding a maximum speed limit by 25 miles per hour or more in an amount ranging from not less than $200 to not more than $500. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 545H, Transportation Code, by adding Section 545.366, as follows: Sec. 545.366. PENALTY: EXCEEDING LIMIT BY 25 MILES PER HOUR OR MORE. Requires a person who commits an offense under this subtitle by exceeding an applicable maximum speed limit by 25 miles per hour or more to be punished by a fine of not less than $200 or more than $500. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 2001.
