SRC-JEC S.B. 271 77(R) BILL ANALYSIS Senate Research Center S.B. 271 77R2877 JMG-DBy: Lindsay Intergovernmental Relations 1/25/2001 As Filed DIGEST AND PURPOSE Currently, retail establishments are not protected by Texas law from potential fires and injuries caused by fireworks, as are churches, schools, and other establishments. As proposed, S.B. 271 adds retail establishments of a certain square footage to the list of protected buildings. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 2154.251(a), Occupations Code, to include a building in which at least 7,500 square feet is available for one or more retail establishments in the list of places within 600 feet of which a person is prohibited from exploding or igniting fireworks. SECTION 2. Effective date: September 1, 2001. Makes application of this Act prospective.
