DIGEST AND PURPOSE 

Currently, scheduling conflicts sometimes arise that prevent county judges
from holding hearings on applications for mass meetings.  S.B. 286
authorizes a county judge to delegate to another county officer the duty of
conducting hearings on applications for mass gatherings. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Chapter 751, Health and Safety Code, by adding Section
751.0055, as follows: 

Sec. 751.0055.  DELEGATION OF DUTIES OF COUNTY JUDGE.  Authorizes a county
judge of a county to file an order with the commissioners court of the
county delegating to another county officer the duty to hear applications
for a permit under this chapter.  Authorizes the order to provide for
allowing the county officer to revoke a permit under Section 751.008.
Provides that an order of a county officer acting under the delegated
authority of the county judge in regard to a permit has the same effect as
an order of the county judge.  Authorizes the county judge, during the
period in which the order is in effect, to withdraw the authority delegated
in relation to an application and authorizes the county judge to hear the
application. Authorizes the county judge to revoke an order delegating
duties under this section at any time. 

SECTION 2.  Amends Section 751.009, Health and Safety Code, to make
conforming and nonsubstantive changes. 

SECTION 3.  Effective date:  upon passage or September 1, 2001.
