SRC-JBJ S.B. 293 77(R) BILL ANALYSIS Senate Research Center S.B. 293 77R2949 DWS-FBy: West Criminal Justice 3/2/2001 As Filed DIGEST AND PURPOSE Under current Texas law, certain information obtained by the use of the magnetic stripe on a Texas driver's license may only by used by law enforcement and other governmental officials. As proposed, S.B. 293 authorizes the Texas Department of Public Safety to permit use of the information contained in this magnetic stripe by a seller or lessor of goods or services if certain specific conditions are met. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 521.126, Transportation Code, to authorize the Texas Department of Public Safety (department) to permit use of the information by a seller or lessor of goods or services if the department ensures that: _the information is used only for the purpose of preventing a specific criminal offense by the seller or lessor or by a customer of the seller or lessor; and _the seller or lessor does not retain the information after it is no longer needed to prevent that offense. SECTION 2. Effective date: upon passage or September 1, 2001.
