SRC-JEC S.B. 335 77(R)BILL ANALYSIS Senate Research CenterS.B. 335 By: Carona Intergovernmental Relations 6/22/2001 Enrolled DIGEST AND PURPOSE Currently, interlocal agreements may be executed among intrastate local governments and agencies and those of states that border Texas. S.B. 335 allows for interlocal cooperation agreements with all other states. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 791.003(4), Government Code, to redefine "local government" to include a county, municipality, special district, or other political subdivision of another state, rather than a state that borders this state. SECTION 2. Amends Section 791.011, Government Code, by amending Subsection (b) and adding Subsection (g), as follows: (b) Makes a conforming change. (g) Requires a governmental entity of this state or another state that makes purchases or provides purchasing services under an interlocal contract for a state agency, as that term is defined by Section 771.002, to comply with Chapter 2161 in making the purchases or providing the services. SECTION 3. Effective date: September 1, 2001.
