SRC-JBJ S.B. 340 77(R) BILL ANALYSIS Senate Research Center S.B. 340 By: Haywood Criminal Justice 1/26/2001 As Filed DIGEST AND PURPOSE Under current Texas law, the offense of making terrorizing threats to any person is a Class B misdemeanor. As proposed, S.B. 340 would enhance the current law to classify such an offense as a Class A misdemeanor, when perpetrated upon a family or household member or a public servant. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 22.07, Penal Code, by amending Subsection (b), and adding Subsections (c), (d), (e), and (f), as follows: (b) Provides that an offense under Subsection (a)(1) or (a)(2), except as provided by Subsection (c), is a Class B misdemeanor. (c) Provides that an offense under Subsection (a)(2) is a Class A misdemeanor if it is committed against a member of the person's family or household or against a public servant. (f) Defines "family," "household," and "public servant." SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 2001.
