SRC-BWC S.B. 363 77(R) BILL ANALYSIS Senate Research Center S.B. 363 77R1736 MCK-DBy: Truan State Affairs 2/15/2001 As Filed DIGEST AND PURPOSE The United States Congress in 1999, passed legislation granting federal employees 30 days paid leave if they serve as organ donors. There are approximately 2,200 people on the waiting list in Texas for kidneys, where there is also a need for bone-marrow and organ donors. As proposed, S.B. 363 gives state employees a leave of absence without a deduction in salary to donate bone marrow or an organ. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 661Z, Government Code, by adding Sections 661.915 and 661.916, as follows: Sec. 661.915. LEAVE FOR ORGAN OR BONE MARROW DONORS. Provides that a state employee is entitled to a leave of absence without a deduction in salary to allow the employee up to five working days to donate bone-marrow and 30 working days to donate an organ in a fiscal year. Sec. 661.916. LEAVE FOR BLOOD DONATION. Requires a state agency to allow each agency employee time off, without a deduction in salary or accrued leave, to donate blood not more than four times in a fiscal year. SECTION 2. Effective date: September 1, 2001.
