HBA-DMH S.B. 377 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 377 By: Shapiro Licensing & Administrative Procedures 4/17/2001 Engrossed BACKGROUND AND PURPOSE Some areas have held local option elections to decide whether to permit or prohibit the sale of certain alcoholic beverages. A city located in two counties is prevented from conducting a local option election regarding the sale of beer and wine. Senate Bill 377 permits an incorporated city or town located in two counties that meet certain population requirements to hold an election to permit or prohibit the legal sale of beer and wine. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 377 amends the Alcoholic Beverage Code to include the option for a local election to permit or prohibit the legal sale of beer and wine in an incorporated city or town that does not permit beer and wine sales on September 1, 2001, and that is located in two counties that meet specified population requirements. EFFECTIVE DATE September 1, 2001.
