SRC-BWC, S.B. 380 77(R) BILL ANALYSIS Senate Research Center S.B. 380 77R371 JJT-DBy: Shapleigh State Affairs 2/6/2001 As Filed DIGEST AND PURPOSE Currently, Texas law does not require that private, for-profit publishers of residential telephone directories include in their directory a listing of state agency Internet addresses. Many state agencies currently maintain Internet websites which contain operation and program information. As proposed, S.B. 380 requires private, for-profit publishers of residential telephone directories to include in their directory a listing of state agency Internet addresses. RULEMAKING AUTHORITY Rulemaking authority is expressly granted to the Public Utility Commission of Texas in SECTION 1 (Section 55.203, Utilities Code) of this Act. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 55.203, Utilities Code, by defining "Internet". Requires the General Services Commission (GSC) to cooperate with the Public Utility Commission of Texas (commission) and with a private for-profit publisher of a residential telephone directory, to be distributed to the public to ensure that the subject matter listing of programs, telephone numbers, and Internet addresses in the telephone directories are consistent with the categorization developed by the Records Management Interagency Coordinating Council under Section 441.203(j) (Records Management Interagency Coordinating Council), rather than Section 441.053, Government Code. Authorizes the commission by rule to specify the format of the listing and criteria for inclusion of agencies, services, and officials. Requires the commission's rules to require a publisher to list telephone numbers and Internet addresses of state agencies. Makes a conforming change. SECTION 2. Amends Section 441.203(j), Government Code, by requiring the Records Management Interagency Coordinating Council to categorize state agency programs, state agency telephone numbers, and Internet addresses of Internet sites maintained by state agencies. Makes a conforming change. SECTION 3. Effective date: September 1, 2001.
