SRC-SEW S.B. 383 77(R) BILL ANALYSIS Senate Research Center S.B. 383 77R4021 GJH-DBy: Lucio State Affairs 2/28/2001 As Filed DIGEST AND PURPOSE Currently, peace officers employed by the Office of the Attorney General are excluded from receiving benefits from the Employees Retirement System even though they perform duties similar to peace officers employed by other agencies. As proposed, S.B. 383 redefines "law enforcement officer" to include those persons commissioned and employed as peace officers by the Office of Attorney General, allowing them to receive benefits from the Employees Retirement System of Texas. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 811.001(9), Government Code, to redefine "law enforcement officer." SECTION 2. Amends Section 814.104(b), Government Code, to make a conforming change. SECTION 3. Amends section 815.505, Government Code, to make a conforming change. SECTION 4. Requires the attorney general, before October 1, 2001, to certify to the Employees Retirement System of Texas (system), in the manner prescribed by the retirement system, the name of each person employed by the attorney general on September 1, 2001, as a law enforcement officer as defined by Section 811.001, Government Code, as amended by this Act, and such other information as the system determines is necessary for the crediting of service and financing of benefits under Subtitle 8B, Government Code. SECTION 5. Effective date: September 1, 2001.
