SRC-MWN S.B. 387 77(R) BILL ANALYSIS Senate Research Center S.B. 387 77R2191 BDH-DBy: Bivins Education 1/26/2001 As Filed DIGEST AND PURPOSE Some veterans of World War II were unable to receive high school diplomas because they served their country during war time. As proposed, S.B. 387 allows veterans of World War II to receive high school diplomas from the high school from which they would have graduated. RULEMAKING AUTHORITY Rulemaking authority is expressly granted to the commissioner of education in SECTION 1 (Section 28.0251, Education Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 28B, Education Code, by adding 28.0251, as follows: Sec. 28.0251. HIGH SCHOOL DIPLOMA FOR CERTAIN VETERANS. Authorizes a school district, notwithstanding any other provision of this code, to issue a high school diploma to a person who is an honorably discharged member of the armed forces of the United States; was scheduled to graduate from high school after 1940 and before 1951; and left high school before graduation to serve in World War II. Authorizes a school district to issue a diploma under this section to a person eligible under Subsection (a) who holds a high school equivalency certificate; or posthumously to a person who, if the person were living, would be eligible under Subsection (a). Requires the commissioner of education (commissioner) by rule to adopt a form for a diploma application to be used by a veteran or a person acting on behalf of a deceased veteran under this section. Requires the commissioner to specify acceptable evidence of eligibility for a diploma under this section. SECTION 2. Amends Section 28.025(a), Education Code, to authorize a person to receive a diploma if the person is eligible for a diploma under Section 28.0251. Makes a nonsubstantive change. SECTION 3. Provides that this Act applies beginning with the 2001-2002 school year. SECTION 4. Effective date: upon passage or September 1, 2001.
