BACKGROUND AND PURPOSE 

Current law requires a school district when hiring a principal from outside
of the district to hire the principal under a probationary contract
regardless of the principal's years of experience.  For this reason, a
qualified principal may be reluctant to change jobs and move to another
district.  Senate Bill 388 allows a school district to hire such a
principal under a term contract, as long as the principal has at least
three years of experience as a principal within the last 10 years.  

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

Senate Bill 388 amends the Education Code to authorize a school district to
employ a person as a principal under a term contract if the person has at
least three years of experience as a public school principal within the
last 10 years regardless of whether the person is being employed by the
school district for the first time or whether a probationary contract would
otherwise be required. 

EFFECTIVE DATE

On passage, or if the Act does not receive the necessary vote, the Act
takes effect September 1, 2001. This Act applies beginning with the
2001-2002 school year.
