SRC-BWC C.S.S.B. 390 77(R) BILL ANALYSIS Senate Research CenterC.S.S.B. 390 77R8123 YDB-DBy: Wentworth State Affairs 3-6-2001 Committee Report (Substituted) DIGEST AND PURPOSE Currently, Texas lottery commissioners are prohibited from discussing the negotiation of the lottery operator contract except during a properly posted open meeting. This eliminates the opportunity to plan and discuss strategy aside from that which occurs in the presence of the person against whom negotiations are being conducted. C.S.S.B. 390 permits a closed meeting to negotiate an operator's contract if the commission determines that an open meeting would have a detrimental effect on the commission's position during negotiations. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 467.030, Government Code, by providing that Section 551.002 does not apply to a closed meeting of the Texas Lottery Commission (commission) relating to the negotiation of an operator's contract if the commission determines, in writing, that an open meeting would have a detrimental effect on the commission's position in the negotiations. SECTION 2. Effective date: upon passage or September 1, 2001. SUMMARY OF COMMITTEE CHANGES SECTION 1. Removes "lottery operator" from the closed meetings with the Texas Lottery Commission. SECTION 2. Adds a two-third vote clause in order to have this bill be effective immediately.
