SRC-JBJ S.B. 402 77(R) BILL ANALYSIS Senate Research Center S.B. 402 77R3505 GWK-DBy: Zaffirini Criminal Justice 2/9/2001 As Filed DIGEST AND PURPOSE Under current Texas law, it is illegal to bring prohibited weapons on to school premises. In this application the term "premises," currently defined as a building or portion of a building, does not include certain peripheral areas such as driveways, sidewalks, and parking areas. As proposed, S.B. 402 expands the definition of a premises to include public or private driveways, streets, sidewalks or walkways, or certain parking areas. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 46.03(c), Penal Code, to redefine and define "premises" for two separate applications. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 2001.
