SRC-TBR S.B. 411 77(R) BILL ANALYSIS Senate Research Center S.B. 411 77R3259 JD-FBy: Shapiro Finance 2/20/2001 As Filed DIGEST AND PURPOSE Currently, the Department of Public Safety administers revenue generating programs, including motor vehicle inspections, drivers licenses, and drivers records. The State Highway Fund provides the funding to administer these functions, yet the revenue generated is deposited to the general revenue fund. As proposed, S.B. 411 directs the fee revenue generated by these programs to the State Highway Fund. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 521.055 (d), (e) and (f), Transportation Code, to delete language regarding fees collected. SECTION 2. Amends Chapter 521C, Transportation Code, by adding Section 521.058 as follows: Sec. 521.058. DISPOSITION OF FEES. Requires that each fee collected under this subchapter be deposited to the credit of the state highway fund. SECTION 3. Amends Section 521.313, Transportation Code, by adding Subsection (c), to make a conforming change. SECTION 4. Amends Section 521.3466, Transportation Code, by adding Subsection (e), to make a conforming change. SECTION 5. Amends Chapter 521R, Transportation Code, by adding Section 521.428, as follows: Sec. 521.428. DISPOSITION OF FEES. (a) Requires that each fee collected, except as provided by Subsection (b) under this subchapter, to be deposited to the credit of the state highway fund. (b) Provides that Subsection (a) does not apply to a fee collected under certain listed sections. SECTION 6. Amends Section 522.029, Transportation Code, by adding Subsection (h), to make a conforming change. SECTION 7. Amends Section 524.051, Transportation Code, by adding Subsection (c), to make a conforming change. SECTION 8. Amends Chapter 548H, Transportation Code, by adding Section 548.508, as follows: Sec. 548.508. DISPOSITION OF FEES. Requires each fee collected by the Department of Public Safety (DPS), except as provided by Section 382.0622 (Clean Air Act Fees), Health and Safety Code, to be deposited to the credit of the state highway fund. SECTION 9. Amends Section 661.003, Transportation Code, by adding Subsection (j), to make a conforming change. SECTION 10. Amends Section 644.153, Transportation Code, by adding Subsection (i), to make a conforming change. SECTION 11. Amends Section 724.046, Transportation Code, by adding Subsection (c), to make a conforming change. SECTION 12. Repealer: Section 662.011 (Motorcycle Education Fund Account), Transportation Code. SECTION 13. Effective date: September 1, 2001. Makes application of this Act prospective.
