DIGEST AND PURPOSE 

Currently, a municipality is authorized to hold an election to create a
municipal development district to provide for development projects in the
district if it has a population of less than 10,000 and is located in more
than two counties, one of which borders the Gulf of Mexico.  As proposed,
S.B. 417 expands the authorization to any municipality located in more than
one county. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 377.002, Local Government Code, as follows:

Sec. 377.002.  New heading:  APPLICABILITY.  Provides that this chapter
applies only to a municipality that is located in more than one county.
Deletes text stipulating that the municipality have a population less than
10,000 and be located in more than two counties, one bordering the Gulf of
Mexico. 

SECTION 2.  Amends Section 377.021, Local Government Code, to stipulate
that a development project under this chapter be beneficial to, rather than
in, the municipal development district. Authorizes the municipality, in the
order calling the election, to provide for the district boundaries to
conform automatically to any changes in the boundaries of the portion of
the municipality included in the district. 

SECTION 3.  Makes application of this Act retroactive.

SECTION 4.  Effective date: upon passage or September 1, 2001.
