SRC-CTC C.S.S.B. 432 77(R)BILL ANALYSIS Senate Research CenterC.S.S.B. 432 77R7842 SMJ-DBy: Carona Health & Human Services 3/9/2001 Committee Report (Substituted) DIGEST AND PURPOSE Currently, an order of protective custody is necessary in order to transfer a person who has been admitted to a county mental health facility under emergency detention from that facility to a facility of the single portal authority or an appropriate inpatient mental health facility. C.S.S.B. 432 sets forth the manner in which a person who has been admitted to a county mental health facility for court ordered mental health services may be transferred to an appropriate mental health facility. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 574A, Health and Safety Code, by adding Section 574.0025, as follows: Sec. 574.0025. TRANSPORTATION AFTER FILING APPLICATION FOR CERTAIN PERSONS. Authorizes a county mental health facility that has completed a preliminary examination of a person for whom an application for court-ordered mental health services is filed to transport the person to certain facilities. Provides that the requirements prescribed by Section 574.045 for transporting a patient apply to a person transported under this section. SECTION 2. Effective date: upon passage or September 1, 2001. SUMMARY OF COMMITTEE CHANGES Differs from the original by replacing the proposed amendment to Chapter 573C, Health and Safety Code, with a proposed amendment to Chapter 574A, Health and Safety Code. Removes proposed amendments to Sections 573.022 and 573.025(a), Health and Safety Code. Redesignates proposed SECTION 4 as SECTION 2.
