SRC-MWN S.B. 446 77(R) BILL ANALYSIS Senate Research Center S.B. 446 77R1146 BDH-DBy: Bernsen Natural Resources 4/19/2001 As Filed DIGEST AND PURPOSE Currently, the fishing license exemption applies only to residents born before September 1, 1930. As proposed, S.B. 446 amends the Parks and Wildlife Code providing that a resident of Texas who is at least 65 years of age is exempt from the requirement of obtaining a fishing license. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 46.002(a), Parks and Wildlife Code, to provide that a license issued under this chapter is not required of a person who is a resident at least 65 years of age, rather than whose birth date is before September 1, 1930, and who is a nonresident at least 65 years of age if the person's state of residence grants a similar age exemption to Texas residents. Makes a conforming change. SECTION 2. Prohibits the Parks and Wildlife Department (department) from implementing the change in law made by this Act to Section 46.002(a) (Exemptions), Parks and Wildlife Code, unless the 77th Legislature expressly appropriates to the department an amount sufficient to recover the costs of implementing the change in law. SECTION 3. Effective date: upon passage or September 1, 2001.
