SRC-MWN S.B. 462 77(R)BILL ANALYSIS Senate Research CenterS.B. 462 By: Duncan Education 5/21/2001 Enrolled DIGEST AND PURPOSE Students enrolled at Texas Tech University are assessed $30 per semester to utilize the Student Recreation Center's programs and services and an additional $25 per semester for recent additions and renovations to the center. S.B. 462 authorizes the Texas Tech University board of regents to create a single consolidated fee to finance the Student Recreation Center and increases the current statutory cap of $25 to $100 for each semester of the regular school year and from $12.50 to $50 for each six-week term or shorter summer session. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 54.508 and 54.509, Education Code, as follows: Sec. 54.508. New heading: MEDICAL SERVICES FEE; TEXAS TECH UNIVERSITY SYSTEM COMPONENTS. Authorizes the board of regents of the Texas Tech University System to charge each student registered at a component institution of the Texas Tech University System a medical services fee not to exceed $100, rather than $55, for each semester of the regular term or 12-week summer session and not to exceed $50, rather than $25, for each six-week or shorter term of the summer session. Authorizes a medical services fee charged under this section to be used only to provide medical services to students enrolled at a component institution of the Texas Tech University System. Prohibits the board from increasing the amount of the medical services fee charged at a component institution of the Texas Tech University System by more than 10 percent from one academic year to the next unless the increase is approved by a majority of the students of the institution voting in a general election held for that purpose. Sec. 54.509. New heading: STUDENT RECREATION FEE; TEXAS TECH UNIVERSITY SYSTEM COMPONENTS. Authorizes the board of regents of the Texas Tech University System, if approved by a student vote, to charge each student enrolled at a component institution of the Texas Tech University System a recreation fee not to exceed $100, rather than $25, per semester or $50, rather than $12.50, per six-week summer term to be used to purchase equipment for and to operate and maintain the student recreation facilities and programs at the institution, rather than university. Prohibits the fee from being increased by more than 10 percent from one academic year to the next unless the increase is approved, rather than changed within the limits specified at any time, by a majority of students voting on the issue in a general election called for that purpose. Redesignates existing Subsections (d) and (e) to Subsections (c) and (d). Deletes text regarding recreation fee. SECTION 2. Provides that this Act applies beginning with the fall semester of 2001. SECTION 3. Effective date: upon passage or September 1, 2001.
